1. Acceptance of Terms

By using Cesta Nova LLC's ("Cesta Nova") AI voice agent service, you agree to these Terms of Service. If you do not agree, do not use our Service.

2. Description of Service

Cesta Nova provides an AI-powered voice agent that answers phone calls and books appointments for businesses. Our Service includes:

  • 24/7 automated phone answering
  • Appointment booking, rescheduling, and cancellation
  • Google Calendar integration
  • SMS confirmations and reminders
  • Call recording and transcription

3. For End Customers (Callers)

When you call a business using our Service:

  • You are interacting with an AI system, not a human
  • Your call will be recorded and transcribed
  • Your appointment information will be shared with the business you called
  • You may receive SMS confirmations (reply STOP to opt out)

4. For Business Clients

4.1 Eligibility

You must be at least 18 years old and have the authority to enter into this agreement on behalf of your business.

4.2 Account Responsibilities

You are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Providing accurate business information
  • Complying with applicable laws and regulations
  • Having your own privacy policy that covers your use of our Service

4.3 Payment Terms

Business clients agree to pay the applicable subscription fees. Fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to interfere with or disrupt the Service
  • Reverse engineer or attempt to extract source code
  • Use the Service to harass, spam, or send unsolicited communications
  • Violate any applicable laws or regulations

6. Service Availability

We strive for 99% uptime but do not guarantee uninterrupted service. We may temporarily suspend service for maintenance or updates with reasonable notice when possible.

7. Limitation of Liability

Cesta Nova provides the Service "as is" without warranties of any kind. To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid in the past 12 months
  • We are not responsible for missed appointments, booking errors, or lost revenue
  • You use the Service at your own risk

8. Indemnification

Business clients agree to indemnify and hold Cesta Nova harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

9. Termination

We may terminate or suspend your access to the Service at any time for violation of these Terms. Business clients may cancel their subscription at any time through their account dashboard.

10. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

11. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.
